§1 General, Scope

(1) The online ordering of products is based on the following General Terms and Conditions (GTC) for online transactions.
(2) By submitting the online order, the user accepts these General Terms and Conditions.
(3) These Terms and Conditions shall also apply to all future transactions with the Customer, provided that they are legal transactions of a similar nature.
(4) Conflicting provisions of the customer’s general terms and conditions shall not apply.

§2 Conclusion of contract

(1) The offers made by Lüchinger Galerie in the online shop are subject to change and non-binding. A customer's order placed through the online shop constitutes a binding offer to Lüchinger Galerie. The customer undertakes to provide truthful information when placing their order.
(2) The contract is only concluded upon Lüchinger Galerie's declaration of acceptance. Confirmation of receipt of the order via email shall be deemed a declaration of acceptance. This does not apply, however, if communication was carried out individually.
(3) The contract text will be stored by Lüchinger Galerie. However, it is not accessible to the customer.

§3 Prices, payment, due date, default

(1) The price at the time of the order shall be decisive for invoicing.
(2) The stated price shall include any applicable Swiss VAT (currently 8.1%). Shipping and packaging costs will be charged separately. Lüchinger Galerie expressly reserves the right to change prices.
(3) All deliveries, both within Switzerland and abroad, are processed only against advance payment. You have the option of paying in advance, by credit card, or by PayPal.

§4 Delivery, shipping costs

(1) Delivery shall be made by sending the purchased item to the address provided by the buyer.
(2) Lüchinger Galerie will endeavor to ship the ordered items as quickly as possible. Delivery of the goods is at the customer's expense and risk, even if partial deliveries are made. No liability is assumed for delivery delays.
(3) The postage and packaging fee for each order shipped within Switzerland is at least CHF 9.00. For shipping to Germany, Austria, and France, the fee is at least CHF 13.00. For other EU countries, the postage costs are at least CHF 18.00.

For shipments with an above-average weight, shipping and packaging costs increase in accordance with the Swiss Post cost structure.

The Lüchinger Galerie reserves the right to pass on price changes in Swiss Post tariffs to its customers.

§5 Retention of title

The goods remain the property of Lüchinger Galerie until full payment has been made.

§6 Warranty

Claims for damages against the Lüchinger Galerie and its employees are excluded unless there is intentional or grossly negligent action.

§7 Revocation

Cancellation is excluded for orders of publications.

§8 Data protection

The processing of personal data (names, postal addresses, telephone numbers, etc.) provided by the customer in connection with the use of the Lüchinger Galerie online service is subject to data protection legislation. Your data will not be passed on to third parties.

§9 Place of jurisdiction and applicable law

(1) Swiss law shall apply exclusively.
(2) The place of jurisdiction for all disputes arising from the contractual relationship shall be Zurich (CH).

§10 Miscellaneous

Lüchinger Galerie reserves the right to amend these Terms and Conditions at any time. Changes will be communicated to the customer in an appropriate manner, particularly through corresponding publications on the Lüchinger Galerie website.

§11 Severability Clause

Should one or more clauses of these Terms and Conditions be invalid, this shall not invalidate the entire contract. The invalid provision shall be replaced by the relevant statutory provision.
